Discussion of recent antitrust cases discussing allegations of use of monopoly power and tying arrangements relevant to medical device and pharma companies. This presentation also discussed the greater clarity provided by the United States Supreme Court in Rockwell International v. United States ex rel. Stone, 549 U.S. 457, 127 S.Ct. 1397 (2007) to a healthcare provider firm’s defense of a whistleblower qui tam action under the False Claims Act.
