In the first episode of West LegalEdcenter’s 2022 series “Bankruptcy Intersections 2022,” premiering on March 31, 2022, SFGH Partner Jonathan Friedland, joined by top labor and employment law professionals, Michael J. Kaczka and Gary Marsh, will take the audience through common employment and labor issues often triggered when a business files for bankruptcy protection. This panel of seasoned experts will also offer best practices to help debtors and their constituents avoid such issues, which can negatively impact a debtor’s ability to restructure under the Bankruptcy Code.
Even before a company files for bankruptcy protection, multiple employment and labor issues can arise. This webinar addresses the ramifications of the failure of a debtor to comply with the Worker Adjustment and Retraining Notification Act (WARN), which requires employers to provide written notice in advance of covered plant closings and mass layoffs under certain conditions and may subject the debtor to liability. It also examines employee wage and claim issues that are often prompted by the filing of a bankruptcy, as well as the special treatment provided by the Bankruptcy Code for collective bargaining agreements and retiree health care benefits, which makes modification or rejection of such agreements more difficult during the bankruptcy proceeding.
